0. Scope & Eligibility

These Terms apply to the PolySputnik web application, live dashboards, APIs, and related services operated by PolySputnik Labs. By accessing any part of the platform you confirm that you are at least 18 years old, legally permitted to use prediction markets in your jurisdiction, and capable of entering into binding contracts.

If you act on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. Supplemental terms may apply to enterprise integrations or API agreements; they will control where they conflict with this document.

1. Acceptance of Terms

By accessing and using PolySputnik, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, please do not use our platform.

2. Service Description

PolySputnik provides prediction market intelligence including AI-powered analysis, sentiment tracking, and trading signals. Our service is provided "as is" without warranties of any kind.

3. No Financial Advice

IMPORTANT: PolySputnik provides information and analysis tools only. We do not provide financial, investment, or trading advice. All trading decisions are made at your own risk. Past performance does not guarantee future results.

You acknowledge that prediction markets involve substantial risk of loss and may not be suitable for all users. You should carefully consider your financial situation before making any trading decisions.

4. Use of Platform

You agree to use PolySputnik for lawful purposes only. You may not:

• Attempt to gain unauthorized access to our systems or networks
• Use automated tools to scrape, download, or extract content excessively
• Redistribute, resell, or commercialize our data or analysis
• Use the platform for market manipulation or illegal activities
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the platform's functionality or servers
• Impersonate any person or entity or misrepresent your affiliation

5. Intellectual Property

All content on PolySputnik, including but not limited to text, graphics, logos, algorithms, code, and data compilations, is the property of PolySputnik or its content suppliers and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from PolySputnik without express written permission.

6. User Accounts (If Applicable)

While PolySputnik currently offers free access without registration, we may introduce user accounts in the future. If this occurs:

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information
• You are responsible for all activities under your account
• We reserve the right to suspend or terminate accounts that violate these terms

7. Limitation of Liability

PolySputnik and its operators shall not be liable for any losses, damages, or costs arising from your use of the platform or reliance on any information provided, including but not limited to:

• Financial losses from trading or investment decisions
• Inaccuracies or errors in data, predictions, or analysis
• Service interruptions, downtime, or technical failures
• Unauthorized access to or loss of data
• Third-party actions or services

To the maximum extent permitted by law, our total liability shall not exceed $100 USD.

8. Indemnification

You agree to indemnify, defend, and hold harmless PolySputnik, its operators, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Any trading or investment decisions made based on platform information

9. Disclaimer of Warranties

PolySputnik is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy, completeness, or reliability of information
• Uninterrupted or error-free service
• Fitness for a particular purpose
• Non-infringement of third-party rights

10. Third-Party Services

Our platform integrates with third-party services and APIs. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of such services is subject to their respective terms and conditions.

11. Dispute Resolution

Any disputes arising from these Terms of Service or your use of PolySputnik shall be resolved through the following process:

1. Informal negotiation: Contact us at legal@polysputnik.com to resolve the issue
2. If informal resolution fails, disputes shall be settled by binding arbitration administered under the Arbitration Rules of the Estonian Chamber of Commerce and Industry (Tallinn, Estonia)
3. Arbitration proceedings will be conducted in English and the arbitral award may be entered in any court
4. You waive the right to participate in class action lawsuits or jury trials

If mandatory consumer law in your jurisdiction prohibits arbitration, disputes shall instead be heard by the competent courts of Tallinn, Estonia.

12. Termination

We reserve the right to suspend or terminate your access to PolySputnik at any time, without notice, for any reason, including violation of these Terms of Service. Upon termination, your right to use the platform ceases immediately.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the platform after changes constitutes acceptance of the modified terms. Material changes will be communicated through the platform or other reasonable means.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Governing Law

These Terms of Service and any related disputes are governed by the laws of the Republic of Estonia, without regard to conflict-of-law principles. You consent to the jurisdiction of Estonian courts for the limited purpose of enforcing arbitration awards or where arbitration is not permitted.

16. Compliance & Regulatory Disclosures

PolySputnik is an information and analytics provider. We are not a broker, investment adviser, or money services business, and we do not custody funds. We comply with applicable EU and UK data protection principles (GDPR/UK GDPR) and honor California Consumer Privacy Act (CCPA) requirements for eligible users. Users are responsible for ensuring prediction market participation is lawful in their jurisdiction.

Where export controls, sanctions, or other regulatory restrictions apply, we may suspend or terminate access without notice to remain compliant with law enforcement and regulatory requests.
